Immigration

A person can make a claim for asylum under Part 11 of the Immigration Rules.

The UN Refugee Convention of 1951 requires a ‘well-founded fear of persecution’ on the basis of one of five convention reasons (race, religion, nationality, political opinion or membership of a particular social group).

Rule 339C of the Immigration Rules defines the grounds for Humanitarian Protection to apply. Part 11B of the Immigration Rules sets out the policy criteria for granting asylum seekers permission to take up employment.

Part 6 of the Immigration and Asylum Act 1999 provides support packages to the asylum seekers.

The protection of human rights is part of UK law through Human Rights Act 1998

Under the Human Rights Act 1998 it is unlawful for any public authorities to act in a way that is inconsistent with the rights set out within the European Convention on Human Rights (ECHR) Human Rights applications are usually made on the basis of family relationships, children, private life or long residence

Human Rights are considered under paragraph 276ADE of the Immigration Rules Appendix FM of the Immigration Rules sets out the eligibility, suitability and immigration status requirements required for family life applications.

The UK has left the EU at 11pm on 31 January 2020

The ‘grace period’ ends on 30 June 2021, which means, from 01 July 2021 EU citizens and their family members who have not regularised their status will remain unlawfully present in the UK Appendix EU of the Immigration Rules provides the immigration route for EU nationals and their family members after Brexit Settled status or pre-settled status may be granted under EU settlement scheme The deadline for applying under EU Settlement scheme is 30 June 2021
