Appendix EU of the UK Immigration Rules provides the route for which an EEA citizen and their family members, and the family members of a qualifying British citizen to apply for settled status/ pre-settled status after 30 June 2021.
If you have not completed 5 years’ continuous residence in the UK, you will be granted a period of 5 years’ limited leave, which is also known as pre-settled status.
If you are the family member of EU, EEA or Swiss national who started living in the UK by 31 December 2020 and your relationship was formed prior to this date, you may need to first apply for the EU Settlement Scheme Family Permit to enter the UK, and then apply for pre-settled status to continue living in the UK. You would need to provide documentation to prove your relationship as a family member to the EU, EEA or Swiss citizen.
Once you have completed five years’ continuous residence, you will be eligible to apply for settled status.
You will not lose your pre-settled status unless you spend 2 years in a row outside the UK
If you wish to qualify for settled status, you will need to maintain your continuous residence. The continuous residence will be lost if you leave the UK for more than 180 days in every 12 months.
If you have completed 5 years’ continuous residence in the UK, you will be granted indefinite leave to remain in the UK, which is also known as settled status. This means you will be able to live and work in the UK indefinitely. You may also eligible to apply for British citizenship 12 months after you have been granted with settled status.
You will lose your settled status if you spend a continuous absence of more than 5 years from the UK (or 4 years if you are Swiss)
