The policy objective HP is to provide international protection to the person who, if returned to the home country, would face a real risk of suffering serious harm.
Rule 339CA of the Immigration Rules defines serious harms to include health penalty, unlawful killing, degrading treatment and armed conflicts.
The Home Office generally will assess whether the criteria for refugee claims are met; if the specific circumstances do not qualify under the set criteria for refugee status, then the Home Office will proceed to consider whether HP applies.
When HP is granted, the Home Office must also detail the reasons for refusing refugee status.
Successful applicant will be granted with initial period of 5 years’ limited leave, which the person can then apply for ILR in the UK.
A grant of a period of leave entitles you to immediate and unrestricted access to work and recourse to public funds.
You may also be eligible to apply for a Home Office Certificate of Travel should you wish to travel abroad, if you are unable to travel with your own national passport.
If family members were included as dependents on your application, they will normally receive the same outcome consistent with your main decision.
