Eligibility

To stay in the UK as a refugee you must be unable to live safely in any part of your own country because you fear persecution there.

The UN Refugee Convention of 1951 requires a ‘well-founded fear of persecution’ on the basis of one of five convention reasons (race, religion, nationality, political opinion or membership of a particular social group). 

You must also be unable to obtain protection from the authorities in your country of nationality. In assessing your eligibility to the claim as a refugee, the Home Office will consider your previous connections to a third country which you are able to claim asylum protection or if you had a reasonable opportunity to have travelled to the UK through a safe third country.  

How to claim

You must register your claim as soon as you can. You can have your screening interview at the UK Border upon entrance to the UK or if you are already in the UK, you must call the Asylum Intake Unit (0300 123 4193) to register your asylum claim.

Your asylum interview will take place after your screening.

In order to establish an asylum claim, merely having a subjective fear of persecution is a necessary but not a sufficient condition. In order for the fear to be well founded, an objective test must also be satisfied, which is the risk of persecution.

it is also important to have a good credibility account in your asylum claim.

If you have a partner and children under 18, they can be included in your application as dependents, or they may submit their own asylum applications.

What you will get

Successful applicant will be be granted with 5 years’ leave to remain.

The person can then apply for Indefinite Leave to Remain (ILR) on the basis of 5 years’ residence in the UK as a recognised refugee, providing the required criteria are met.
